Terms of Use

1. Agreement

These terms are an agreement between you and Nerd Crew, an independent developer based in Poland (“we”, “us”), for the use of the Language Nerd app and its content (the “app”). By installing or using the app you accept these terms and our Privacy Policy. If you do not accept them, please do not use the app.

If you use the iOS version, Apple’s standard Licensed Application End User License Agreement also applies. If it conflicts with these terms on a point it covers, Apple’s terms prevail on that point. Apple and Google are not parties to these terms and are not responsible for the app, its support or your claims about it, except as their own terms provide.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on your devices for your own learning, and not for resale or commercial use. All rights not expressly granted remain with us.

3. Who may use the app

The app is suitable for all ages. If you are a child, please use it with the knowledge of a parent or guardian. Purchases must be made, or approved, by an adult who is allowed to make them under the law and the rules of the store.

4. Free version and Pro subscription

Part of the app is free. Pro is an optional auto-renewing subscription that unlocks additional features. The features, the available periods (for example 1, 3, 6 or 12 months) and the price in your currency are shown on the subscription screen before you buy.

5. Your progress

Your learning progress belongs to you. We store it on your device and, if you choose, in your Google Play Games or Apple iCloud account (see the Privacy Policy). You are responsible for keeping your device and accounts secure. We may not be able to recover progress that was lost together with the device if cloud save was not enabled.

6. Acceptable use

You agree not to: (a) copy, modify or reverse engineer the app’s code, except where the law allows it despite this restriction; (b) circumvent or tamper with purchases, subscription checks or advertising; (c) use cheats, automation or exploits that interfere with the app or other people’s use of our services; (d) use our servers in a way that overloads them. This does not restrict what you may do with the open-licensed dictionary data described in section 8 under its own licence.

7. Educational content

The app is a learning aid. Word lists, translations, example phrases, pronunciation hints and level labels are compiled from open sources and processed automatically and by us, and may contain mistakes or may not fit every context. They are not professional, legal or medical advice and are not a guarantee of any exam result or fluency. If you find an error, please tell us at jeka.corvus@gmail.com.

8. Third-party data and licences

The dictionaries are built from open data, in particular:

The dictionary databases that the app downloads are derived from these sources and are shared under the same CC BY-SA licence. A full list of sources is also available inside the app on the “Data sources” screen. Open-source components used in the app remain under their own licences.

9. Availability, changes and termination

We may change, suspend or discontinue features or the app, or update the dictionaries, at any time, for example to fix errors or comply with the law. We will try to give reasonable notice for changes that significantly affect a paid subscription. You may stop using the app at any time. We may restrict access if you seriously or repeatedly breach these terms.

10. Warranty and liability

The app is provided “as is” and “as available”. To the extent the law allows, we do not give warranties that the app will be uninterrupted or error-free, and we are not liable for indirect or consequential loss, loss of data (including progress) or loss of profit. Our total liability for direct loss arising from the app is limited to the amount you paid us in the 12 months before the claim, or to EUR 50 if you paid nothing. None of this limits liability that cannot be limited by law, including for intentional harm or gross negligence and for death or personal injury, and it does not affect your statutory rights as a consumer, including the legal guarantee of conformity of digital content and services.

11. Governing law and disputes

These terms are governed by the law of Poland. If you are a consumer, you also keep the protection given to you by the mandatory rules of the country where you live, and you may bring a claim in the courts of that country. Otherwise, the competent courts are those of the place where Nerd Crew is based in Poland.

12. Changes to these terms

We may update these terms, for example when the app or the law changes. The date at the top shows the latest version. If you keep using the app after a change takes effect, you accept the updated terms; where the law requires, we will ask for your agreement or give notice in advance.
